Yup...that's the guy. I had a trial where the sole issue was identification. 
Halfway through the victim's trying to describe the characteristics of his 
assailant, height, weight, clothing etc., he turned and looked at my 
client: "Oh that's the same shirt he was wearing when he attacked me." I 
turned to my guy, who sheepishly looked back at me and uttered the classic 
line "Whoops, I forgot."
